Patent Registration in India: Filing, Examination & Patent Protection

An Indian patent application protects a qualifying invention through the procedure under the Patents Act, 1970 and Patents Rules, 2003, as amended. Filing is not the same as grant. An applicant ordinarily prepares the technical specification, submits the prescribed application, requests examination, addresses Patent Office objections and maintains a granted patent through renewal and other applicable compliance.

General information for inventors, startups and businesses. Technical drafting, inventorship, ownership and patentability must be assessed for each invention.

What is a patent, and what does patent registration mean?

A patent is a time-limited statutory right granted for an invention that meets the legal requirements. “Patent registration” commonly refers to the application and grant process, although the legal terminology is patent filing, examination and grant. An application number proves that a filing occurred; it does not prove the invention is patentable or that a patent has been granted.

Under the Patents Act, a granted patent confers defined rights to prevent unauthorised making, using, offering for sale, selling or importing the patented product, or use of a patented process and dealing in products directly obtained through that process, subject to the Act and exceptions. The claims in the granted specification determine the scope of protection; a marketing description or an abstract is not a substitute for carefully drafted claims.

The ordinary patent term is 20 years from the filing date, subject to applicable statutory rules for the application category and timely payment of renewal fees. Protection is territorial: an Indian patent does not automatically confer enforceable patent rights in another country. A founder planning foreign manufacturing, licensing or exporting should consider the relevant overseas filing strategy before public disclosure.

A patent differs from copyright, trademark and registered design protection. Patent claims protect qualifying technical inventions; copyright ordinarily protects original expression rather than a technical idea; trademarks distinguish trade origin; and design registration concerns eligible visual features of an article. A product may involve more than one right, but each has different conditions and procedures.

  • Filing stage: an application and filing acknowledgement, not a grant.
  • Publication stage: the application becomes publicly accessible under the applicable publication process.
  • Examination stage: the Controller considers statutory requirements and any objections.
  • Grant stage: enforceable rights arise in accordance with the Act, subject to challenges and limitations.

Which inventions can qualify for patent protection?

A potentially patentable invention must be a new product or process involving an inventive step and capable of industrial application, and must not fall within statutory exclusions. A useful or commercially successful idea is not automatically patentable. A prior-art assessment, technical disclosure and careful claim drafting are essential.

Novelty requires considering what has already been made available to the public through patents, publications, products, talks, websites, demonstrations and other disclosures. An inventive step calls for legal and technical analysis beyond merely describing a small improvement as “innovative”. Industrial application concerns whether the invention can be made or used in an industry as understood under the Act.

Section 3 excludes several categories, subject to its precise wording and applicable interpretation. Examples include discoveries of natural principles or substances, mere admixtures that only aggregate component properties, certain methods of agriculture or horticulture, methods of treatment of humans or animals, and computer programmes per se. Section 4 separately deals with inventions relating to atomic energy. Whether a technology falls within an exclusion requires analysis of its actual claims and technical contribution.

For software, artificial-intelligence systems, agricultural equipment, food processing and biotechnology, the description of the underlying technical problem and the actual solution matters. Calling an invention a “device”, “AI patent” or “startup invention” does not bypass the statutory tests. Patent professionals should review the complete engineering or scientific disclosure before promising a filing route.

A patentability search and a freedom-to-operate assessment answer different questions. Patentability asks whether your claims might qualify for grant. Freedom to operate asks whether commercial activities might infringe someone else’s existing enforceable patent, including patents on components or manufacturing methods. Even a granted patent is not a blanket permission to manufacture or sell.

  • Newness: compare the claims against relevant earlier disclosures.
  • Inventive step: identify the technical advance and non-obvious contribution.
  • Industrial application: document how the invention can actually be made or used.
  • Excluded subject matter: assess Sections 3 and 4 before committing to a filing.
  • Entitlement: establish the inventors and applicant’s lawful right to apply.

Who can apply for an Indian patent?

The Patents Act recognises applications by a person claiming to be the true and first inventor, an assignee of that person, or a legal representative in the prescribed circumstances. A company, startup or institution may apply where its entitlement is properly established. Inventorship and ownership are related but distinct questions.

An inventor is identified by a contribution to the claimed invention, not by job title, funding alone or business seniority. The applicant may be the inventor or another entitled person, such as a company holding an appropriate assignment. If employees, consultants, university researchers or multiple collaborators developed the invention, examine their contracts and the evidence of who contributed to the inventive concept.

Where a business is incorporating, patent ownership should be considered before selecting the applicant. A founder may own a pre-incorporation invention personally; a newly formed company does not necessarily own it merely because the founder becomes its director. An appropriate written assignment or employment arrangement and the required filing particulars may be needed to establish a coherent ownership chain.

The classification of the applicant affects official patent fees. The Patent Office distinguishes natural persons, startups, small entities, educational institutions and other entities according to the prescribed conditions and documentary evidence. Form 28 is relevant when claiming prescribed startup or small-entity status. A fee classification must be verified, not assumed from the name “startup” or from Udyam registration alone.

How do provisional and complete specifications differ?

A provisional specification may establish an early filing date for the matter it adequately discloses, but it does not eliminate the obligation to submit a complete specification. Where an Indian application starts with a provisional specification, the complete specification must be filed within 12 months; the Patent Office states that no further extension is available for that requirement.

A provisional specification is not simply a short marketing note. It should describe the invention sufficiently and accurately, supported by drawings or examples where useful. Later claims receive the benefit of an earlier date only to the extent supported by the relevant disclosure and applicable law. Poor early drafting can produce a false sense of priority for features added after the first filing.

A complete specification must describe the invention and its operation or use, disclose the best method of performing it known to the applicant as required by law, and end with claims defining the protection sought. An abstract and drawings, where needed, accompany the filing. The technical scope of the claims is often the central commercial and litigation issue.

Choosing between provisional and complete filing is a strategic decision based on technical readiness, disclosure risk, budget and planned development. A provisional application is not compulsory; an inventor with a sufficiently developed invention can file with a complete specification from the outset. Neither route guarantees grant.

Do not confuse an engineering prototype with an adequate patent specification. A physical prototype can be valuable evidence and may clarify dimensions, manufacturing steps and performance; however, a working prototype is not universally required to file. Likewise, unsupported functional promises cannot replace an enabling description.

  • Provisional: priority-focused initial technical disclosure, where appropriate.
  • Complete: enabling description, claims, abstract and appropriate drawings.
  • Critical deadline: complete specification within 12 months of a provisional filing.
  • Disclosure review: check every essential feature before external presentations.

Which patent forms and documents are relevant?

The correct filing bundle depends on the applicant, application type, specification and procedural requests. The Indian Patent Office lists the forms and the First Schedule fee table on its official website. Applicants should use the current forms and verify the applicable electronic-filing fee at submission.

Form 1 is the application for grant. Form 2 contains the provisional or complete specification. Form 3 concerns the statement and undertaking under Section 8 regarding corresponding foreign applications where relevant. Form 5 addresses inventorship. These should reflect the actual disclosure and ownership documents.

Form 9 is used to request early publication where appropriate. Form 18 requests ordinary examination, while Form 18A is used for expedited examination if the applicant meets a prescribed eligibility category and other conditions. Form 26 is relevant to authorisation of a patent agent or another person in a proceeding under the Act; regulated professional representation should be checked for the particular task.

Other forms are event-specific: Form 7A for pre-grant opposition representations, Form 7 for post-grant opposition, Form 13 for qualifying amendments, Form 25 for relevant foreign-filing permission, Form 27 for prescribed working statements, and Form 28 for claiming eligible small-entity or startup fee status.

The filing team should keep a controlled evidence pack. It can include inventor identification, applicant constitution documents, assignments, inventor declarations, prior-art search results, drawings, laboratory records, dated design iterations, publication history, funder or collaborator contracts and proof of the claimed fee category. Not every item is filed with every application, but omissions can become difficult to cure later.

Quick comparison: common patent forms

Use the form appropriate to the actual procedural event; submitting an application is different from requesting publication, examination or post-grant maintenance. Current form versions and supporting material should be confirmed on the Patent Office portal.

How does the Indian patent application process work?

An Indian patent ordinarily proceeds through pre-filing assessment, specification drafting, electronic filing, publication, a timely examination request, consideration of the First Examination Report, and a grant or refusal decision. The sequence depends on the application type and any opposition, hearing, amendment or special statutory procedure.

Step 1 — Document and confidentiality review. Gather the technical problem, existing alternatives, inventive features, drawings and development record. Identify inventors, applicant entitlement, previous disclosure and potential collaborators. Confidentiality should be addressed before unrestricted publication or supplier demonstrations.

Step 2 — Search and patentability assessment. Review relevant Indian and international patents, scientific literature and publicly available product information. Document the apparent differences and the risks arising under Sections 3 and 4. A search reduces uncertainty but cannot prove global novelty conclusively.

Step 3 — Filing strategy and specification. Decide whether provisional or complete filing is suitable. Define the invention with sufficient technical detail, examples, alternatives and drawings. For a complete filing, develop a claim set consistent with the disclosure and the applicant’s commercial priorities.

Step 4 — Prepare forms and file. Complete the appropriate Form 1, Form 2 and other applicable documents, confirm fee classification and submit using the authorised Patent Office filing system. Save the filing acknowledgement, payment receipt, documents actually submitted and priority details.

Step 5 — Monitor publication and request examination. Applications normally follow the statutory publication process, subject to exceptions; an applicant may use Form 9 for early publication where suitable. Submit Form 18 or eligible Form 18A within the period applicable to that filing. Publication by itself does not amount to an examination request.

Step 6 — Respond to the First Examination Report. Examine the Controller’s novelty, inventive-step, clarity, support, unity and exclusion objections. Prepare a technically substantiated response and amendments where legally permitted. A response should address the actual citations and claims, not merely assert that the invention is unique.

Step 7 — Hearing, opposition and decision. Where the proceeding requires a hearing or where a third party files a statutory opposition, prepare the record and submissions under the applicable rules. The final outcome depends on the evidence and the Controller’s order; no filing agent can guarantee grant.

Step 8 — Post-grant management. Review grant details, diarise renewal fees, maintain assignments and licences where applicable, address prescribed working statements and monitor potential infringement or competing filings. Commercial protection requires continuing legal and operational attention.

What deadlines should patent applicants track?

The 12-month period following a provisional filing and the time for requesting examination are particularly important. Rule 24B, as amended in 2024, generally prescribes a 31-month examination-request period for applications governed by the amendment; an express transitional provision preserves the earlier applicable period for applications filed before commencement of those amendment rules.

The Patent Office publishes applications under Section 11A, generally after the prescribed 18-month period unless an exception or an appropriate early-publication request applies. Public access at publication may expose technical details and support statutory opposition rights, so the filing sequence should be coordinated with product launches and publicity.

The First Examination Report starts a separate response and compliance timetable. The precise date must be taken from the actual communication, current rules and permitted extension provisions rather than an estimate based on ordinary processing time. Hearings, pre-grant opposition and foreign counterparts can alter practical planning.

For foreign filing, a person resident in India must consider Section 39 and the applicable first-filing or permission conditions before making an application outside India. An Indian filing is not a worldwide filing, and Patent Cooperation Treaty international filing has its own application, priority and national-phase requirements. A product export plan is not a substitute for a jurisdiction-by-jurisdiction IP strategy.

After grant, renewal fees and other prescribed compliance must be maintained. The working-statement requirements were amended in 2024; rely on the current Form 27, relevant periods and Patent Office instructions instead of copying an older annual-template practice. Any specific fee or date should be checked against the official electronic-filing portal at the time of action.

  • Complete specification after provisional: within 12 months; no general further extension.
  • Request for examination: generally 31 months under amended Rule 24B for covered applications; check transitional rules for older filings.
  • Ordinary publication: generally after the prescribed 18-month period, subject to exceptions.
  • Foreign filing and PCT: diarise separate statutory and treaty-driven requirements.
  • Post-grant: monitor renewal fees and current working-statement obligations.

What do patent registration and professional assistance cost?

Patent expenditure has different components: Patent Office fees, specification and claim drafting, prior-art and technical analysis, prosecution responses, hearings if necessary, foreign filings and later renewal fees. A single advertised “patent registration price” may omit significant stages or costs.

The official First Schedule differentiates prescribed applicant classes and chargeable events. An individual or eligible startup may qualify for a different official rate from another entity, but the eligibility documents and ownership structure must actually satisfy the rules. Government fees can also depend on the number of claims and specification pages and on the filing channel or service requested.

A provisional filing may have a lower immediate drafting scope than a fully developed claim set in some cases, but it is not necessarily the cheapest overall approach when the complete specification must still be filed. Technical complexity, multiple embodiments, mechanical drawings, sequence listings or cross-border claims can materially affect preparation effort.

The office’s service fee, government charges, third-party patent-search costs and patent-agent or specialist-drafting fees should be described separately in an engagement estimate. Before paying, confirm whether the quote includes searching, forms, technical specification, claims, FER response, hearing attendance, amendments and grant-stage handling. Do not infer that payment guarantees patentability or government approval.

For Bihar-based founders, evidence of eligible startup or small-entity status should be assessed early enough to apply the correct fee category. A company’s registration certificate does not on its own determine patent fee classification or ownership of an employee-created invention.

What happens after publication, examination and grant?

Patent publication, examination and grant are legally different events. Publication generally makes the application accessible; examination tests the claims and compliance with law; grant follows the Controller’s statutory determination. Opposition and later validity challenges may arise even where the invention has been commercially used.

A pre-grant opposition representation under Section 25(1) and the prescribed procedure can be made in the circumstances allowed by the Act. A post-grant opposition under Section 25(2) is a distinct proceeding with a different standing requirement and statutory period. The person opposing and the patent applicant or patentee must assess grounds and evidence rather than assume that every objection follows the same process.

Claims may be amended only within statutory constraints; adding matter that was not originally disclosed cannot be treated as a routine correction. A technically narrow but valid claim may offer useful commercial protection, whereas an expansive claim lacking support can invite objections or later challenge. Work with the technical team on each proposed claim amendment.

If a patent is granted, the patentee should preserve the grant record, monitor term and renewal fees, evaluate licences or assignments, and record rights where the Act requires. A patent can be valuable for investment discussions and licensing, but its economic worth depends on claim scope, validity, product demand, competition, enforceability and territory.

Enforcement is not automatic: infringement disputes require comparison of a product or process with the claims, examination of statutory exceptions, and assessment of remedies and evidentiary burdens. A patent grant is not a certification that a product is safe, effective, market-ready or approved by sectoral regulators.

How do startups, software teams and university inventors avoid filing mistakes?

Innovators benefit from a coordinated patent, ownership and disclosure plan before communicating a technical idea publicly. A patent filing cannot repair every earlier publication problem, and incorporation documents do not automatically settle who owns an invention made before the company existed.

Confusing inventor with investor. Funding, supervision or being a director does not by itself establish inventorship. Record the actual technical contributions and ownership assignments.

Announcing the invention before review. Conference presentations, social media demos, pitches without confidentiality safeguards, published research and vendor brochures may create prior-art or novelty issues. Any statutory grace-period exception is narrow and must be assessed on its facts.

Filing vague specifications. A high-level idea, desired business outcome or abstract algorithm may not adequately support technical claims. Include implementation details and alternative embodiments appropriate to the technology.

Assuming software is always patentable or always excluded. Section 3(k) requires attention to the actual claimed subject matter and technical contribution. The case cannot be decided by the label “app”, “AI”, “machine learning” or “computer program” alone.

Missing an examination request. Filing Form 1 and Form 2 does not automatically trigger substantive examination. Missing the applicable Form 18/18A deadline can result in the application being treated as withdrawn under Section 11B.

Assuming an Indian patent covers exports. An Indian grant is territorial. Foreign product markets and manufacturing locations require separate IP and freedom-to-operate review.

Mixing brand and invention protection. A trademark may protect a business name or product mark; copyright may protect original artwork or software expression; a design registration may protect eligible appearance. None is a substitute for properly assessing a technical patent claim.

Omitting post-grant controls. Renewal and working-statement compliance, assignments, licence records and monitoring should be assigned to a responsible person with a tracked calendar.

Fictional Bihar makhana example: can food-processing innovation be patented?

A Bihar makhana venture may examine patent protection for a genuinely new and inventive technical process or apparatus, but not merely for the idea of selling makhana, a commonplace recipe or a brand name. The following hypothetical example is educational and does not describe an actual client, patent application, shipment or commercial result.

Assume three entrepreneurs in Darbhanga plan to manufacture packaged makhana and incorporate a private limited company. One founder develops a modified controlled-temperature roasting apparatus with a specific mechanical arrangement and measurable process parameters intended to address breakage and energy use. Before showing the apparatus at a trade fair, the founders document the design, conduct an initial prior-art review and consider whether the claimed arrangement satisfies novelty, inventive step, industrial application and the Section 3 exclusions.

They also determine who actually invented the mechanism. If the founder developed it before incorporation, the company should not assume that the patent application belongs to it automatically. The group considers the correct inventor particulars and an appropriate assignment or other entitlement record if the company is to become the applicant. A drafted specification describes the technical construction and practical operation rather than claiming the broad idea of roasting makhana.

The business can consider whether a provisional application is justified by technical readiness or whether a complete specification is feasible at once. Any provisional filing would require completion within the non-extendable 12-month window described by the Patent Office. Once the application is filed, Form 18 or eligible Form 18A must still be requested within the applicable period.

Independently of patent filing, the company examines food-business licensing or registration, packaging and labelling, company and tax compliance, product testing and any other applicable domestic requirements. If it later plans international trade, it considers DGFT/IEC requirements, APEDA-related requirements where applicable, customs classification, bank processes, buyer contracts, destination-country food rules and relevant overseas patent or freedom-to-operate questions.

In this example, incorporation identifies the business vehicle, the patent process addresses technical IP, the trademark protects the chosen brand where eligible, and export compliance addresses permission to trade in particular goods and markets. Success in one workstream does not guarantee approval, protection or success in another.

How can Bihar Tax Consultant assist with patent-related enquiries?

The office can help entrepreneurs organise their invention disclosures, identify ownership and entity-documentation issues, coordinate the patent filing workflow and assess which documents and qualified technical or patent-specialist inputs may be required. The engagement scope, professional representation and technical drafting responsibilities should be confirmed case by case.

For technical patent prosecution, work should be allocated to professionals who are legally authorised and competent for the relevant task. A patent agent’s statutory role and the representation provisions of the Patents Act should be respected; this page does not claim that each listed advocate or tax consultant is a registered patent agent.

Business legal work can include inventor–company assignment documentation, confidentiality arrangements, collaboration contracts, licensing terms, corporate approvals, tax and regulatory coordination and records management. These are connected to patent strategy but do not replace competent claim drafting or Patent Office examination.

For Patna and Bihar enquiries, share a high-level description of the technology without disclosing confidential enabling details through an unsecured public contact channel. The office can discuss the engagement process by telephone; availability, fees and the relevant professional team should be confirmed before work begins.

Provisional Specification

Complete Specification

Patent

Patent Registration FAQs /

Is a patent automatically granted after filing?

No. Filing creates an application record. A patent is granted only after the statutory publication, examination and decision process, subject to applicable objections and requirements.

Can I file an Indian patent application online?

Yes. The Indian Patent Office provides electronic filing. The applicant must use the current forms, sign or authorise the filing appropriately and pay the prescribed fees.

Is a provisional patent a granted patent?

No. A provisional specification is part of an application strategy, not a granted patent. A complete specification must follow within 12 months where a provisional specification was initially filed.

Can I extend the 12-month provisional-to-complete deadline?

The Patent Office states that no further extension is available after the 12-month period for filing the complete specification following a provisional filing.

What forms are normally used for patent filing?

Form 1 is the application and Form 2 contains the specification. Form 3, Form 5 and other forms apply according to the filing facts and current rules.

When must examination be requested?

Amended Rule 24B generally provides 31 months for applications governed by the 2024 change, calculated under the rule; an express transition preserves the earlier applicable period for older filings.

What is Form 18A?

Form 18A is the request for expedited examination, available only where the applicant and filing meet the prescribed eligibility conditions.

Can I patent only an idea?

A broad idea without a qualifying technical invention and adequate disclosure is not enough. Novelty, inventive step, industrial application, exclusions and supporting claims must be assessed.

Can software or an AI tool be patented in India?

The answer depends on the actual technical invention and claims, including Section 3(k). A computer programme per se is excluded; labels such as AI or software do not decide the legal analysis.

Does an Indian patent protect my invention worldwide?

No. Patent rights are territorial. Other jurisdictions require their own filing and grant strategy, and commercial activities may require separate freedom-to-operate review.

Can my company file for an invention created by its founder?

A company may apply where it has lawful entitlement. A founder’s pre-incorporation invention may require assignment or other ownership documentation; incorporation alone does not transfer it automatically.

What happens after a patent is granted?

The patentee should diarise prescribed renewal fees, applicable working-statement requirements and records of assignments or licences, while monitoring the scope and enforceability of the granted claims.
