Protect your original work with accurate documentation. Copyright protection, registration, ownership and enforcement are different issues. Explore the correct filing route and practical requirements below.
Copyright registration is an application to enter details of an eligible work in the Register of Copyrights maintained by the Indian Copyright Office. Under the Copyright Act, 1957, original literary, dramatic, musical and artistic works, cinematograph films and sound recordings can receive protection subject to statutory conditions. Copyright ordinarily arises through creation of an eligible work, not because a registration certificate has been issued. Registration provides an official record and is often valuable when documenting authorship, title and ownership.
Bihar Tax Consultant assists with copyright-registration enquiries concerning books, educational material, visual artwork, logos, packaging, website content, computer programs, audio and video productions. The correct filing category, applicant and supporting proof depend on what is being protected. Our first step is to examine the work and the chain of title rather than promising that every submission qualifies for registration.
For businesses in Patna and across Bihar, copyright is one component of an intellectual-property strategy. A logo may also raise trademark questions, an industrially applied design may require analysis under the Designs Act, a brand name may be more appropriately addressed through trademark law, and a technical invention may need patent advice. An application should identify the particular expression to be protected and avoid presenting copyright as a monopoly over an abstract idea or business concept.
Under Section 13, the statutory classes include original literary, dramatic, musical and artistic works, cinematograph films and sound recordings. The Copyright Office maintains separate registration parts for literary and dramatic works, musical works, artistic works, films, sound recordings and computer programs. Classifying the work correctly affects both the details requested and the material to be uploaded.
Literary works can include books, original written teaching material, articles, manuals and qualifying compilations. Computer programs are recognised within copyright law and handled as a distinct category in the registration system. A literary registration for a website text does not automatically cover every photograph, font, illustration or third-party resource displayed on the site.
Artistic works include qualifying drawings, paintings, graphics, photographs and other artistic expression recognised by the Act. A commercially used logo or label demands additional attention to the trademark-search certificate rule. An original song may involve several distinct rights: underlying lyrics, musical composition and a specific sound recording. Similarly, a film comprises its own copyright while rights in underlying material need separate review.
Copyright protects expression subject to statutory limits and exceptions; it does not protect an idea in isolation. Before filing, identify the actual work, its author or authors, the relevant creation and publication history, any pre-existing material and whether the applicant owns all rights being claimed.
Original text, manuals, scripts and qualifying literary expression.
Original graphics and labels, with TM-C requirements where applicable.
Computer programs and qualifying original content; verify source-code upload rules.
Classify the underlying compositions, lyrics, films and recordings separately.
A copyright application concerns the protected expression contained in a qualifying work. Trademark registration focuses on a mark used to distinguish the goods or services of one business from those of others, while patents concern inventions satisfying a separate statutory test. A founder who asks to “copyright a business name” may actually be seeking trademark advice. A company seeking to protect a product illustration may need both copyright and trademark analysis.
A food-packaging example shows why the distinction matters. The name of a makhana brand, its illustrated packaging, its packaging shape and the recipe or production technology raise different legal questions. An original illustrated label may qualify as artistic expression; trademark law may address the brand identity; designs law may be relevant to an industrial design; confidential know-how may require contractual controls. No one filing guarantees all of these protections.
For commissioned work, ownership can also be different from possession of a file. Paying a designer for a logo does not by itself answer every question about copyright title. The commissioning agreement, employment relationship, applicable statutory rule and any written assignment must be checked before a business applies as owner.
| Protection | Primary concern | Typical example |
|---|---|---|
| Copyright | Original expression | Logo illustration, book, source code |
| Trademark | Brand identity for goods/services | Trading name or source-identifying logo |
| Design | Eligible visual features of articles | Protectable industrial product design |
| Patent | Qualifying invention | Eligible technical invention |
Section 45 permits an author, publisher, owner or other person interested in copyright to apply in the prescribed form and pay the prescribed fee. Eligibility to make an application should not be confused with the merits of an ownership claim. The applicant must disclose the particulars accurately and support the position claimed, especially where the person who created the work is not the person filing.
Section 17 sets out the first-ownership framework subject to statutory exceptions and agreements. Section 18 deals with assignment, and Section 19 addresses the mode of assignment. When a company seeks registration of a creative work prepared by an employee, consultant, freelancer, agency or co-author, the contractual documents and factual circumstances determine how its title should be presented. A mere invoice, logo file or website login may not provide a complete chain of title.
For joint works, identify the contributions and actual rights of each participant. For an audiovisual production, verify agreements with scriptwriters, composers, performers, producers and others as relevant. For software, review employment and development contracts and avoid disclosing third-party source code as if it belonged to the applicant.
An unpublished work may also be filed, subject to the applicable rules and documentary requirements. The status of publication, date and place of creation, language, author details and location of the original work should be recorded consistently. False statements or unsupported NOCs create risk rather than strengthening the application.
For an artistic work that is used, or is capable of being used, in relation to goods or services, the proviso to Section 45(1) requires a certificate from the Registrar of Trade Marks addressing identical or deceptively similar marks in the terms set out in that provision. Commercial logos, brand labels and food packaging frequently require assessment under this rule. The Copyright Office artistic-works manual also discusses a Trade Marks Registry search certificate, commonly called TM-C, for such applications.
Not every artistic work falls within the commercial-artwork situation. An independently created painting with no relevant goods or services use may follow a different documentary route. Do not describe all illustrations as automatically requiring TM-C, or assume that a copyright registration itself grants trademark protection.
If a designer created the logo, establish whether the business has acquired the relevant rights. Check the work submitted, author details, assignment or no-objection material, and trademark-related documents. Where original packaging includes stock images, licensed fonts or purchased artwork, separate those elements from the expression actually owned by the applicant.
The documentation depends on the category of work, whether it is published or unpublished, the applicant’s legal status and whether ownership differs from authorship. Prepare the file before online entry; incomplete or inconsistent applications may lead to a discrepancy or further enquiry. The following is a practical checklist, not a representation that every item is mandatory in every category.
The portal currently describes a PDF containing at least the first 10 and last 10 source-code pages, or all pages if the program has fewer than 20; confirm current instructions before uploading.
Rule 70 requires Form XIV and provides that each application concerns one work. The portal guides applicants through the application, statement of particulars, upload of the work and additional information where applicable, followed by fee payment. Submission generates a diary number for tracking; the diary number is not a registration certificate or a decision on ownership.
Rule 70 also requires notice of the application to persons claiming an interest in the subject matter or disputing the applicant’s rights. The rule describes a thirty-day objection period from receipt of the application. After that period, the Registrar still has to be satisfied about the correctness of the particulars. An objection or a concern about the particulars can lead to further inquiry; the application should not be advertised as automatically approved on day thirty.
The Copyright Rules’ Second Schedule specifies fees by transaction and work class. At the time of this review, the official schedule lists ₹500 per work for ordinary literary, dramatic, musical or artistic applications, ₹2,000 for artistic work used or capable of being used in relation to goods or services, ₹5,000 for a cinematograph film and ₹2,000 for a sound recording. The applicable fee must be checked against the category selected and the live payment page before filing.
The fee for government processing is different from any professional drafting, document-review, trademark-certificate or other related service charge. A file involving multiple works, disputes about title, commissioned art or missing documentation can require additional work. We do not publish a single bundled price without confirming the scope.
The thirty-day period in Rule 70 is an objection period, not a guaranteed certificate-delivery deadline. Review of the application, deficiency correction, objection proceedings, hearing schedules and office workload can affect timing. A service provider should never promise issuance on a fixed date or imply that a diary number proves acceptance.
| Application category | Official schedule fee |
|---|---|
| Ordinary literary, dramatic, musical or artistic work | ₹500 per work |
| Commercial artistic work for goods/services | ₹2,000 per work |
| Cinematograph film | ₹5,000 per work |
| Sound recording | ₹2,000 per work |
Figures come from the official Second Schedule as reviewed on 3 October 2026; verify at payment.
An office discrepancy and a third-party objection are not identical. A discrepancy can concern missing or inconsistent information, work copies, signature, title, author details, supporting documents or fee treatment. A third-party objection may dispute authorship, ownership, similarity or another legally relevant matter. The correct response should address the actual notice instead of sending a generic explanation.
When objections are received or the Registrar is not satisfied with the particulars, Rule 70 permits the Registrar to conduct an inquiry considered appropriate. The outcome depends on the evidence and applicable law; it can involve further documents, a hearing, an entry in the register or an adverse decision. Do not assume that withdrawing an objection will cure a defective title chain.
Preserve dated drafts, original files, development records, author communications, publication records, contracts, copyright assignments and NOCs. Compare each claim in the application with the source document. If a genuine dispute over ownership or infringement already exists, consider the appropriate civil or other legal strategy separately from the administrative registration application.
Keep the registration particulars, original work, drafts and underlying proof of creation in a secure repository. Record the actual rights owned and any licensed uses. Register changes in particulars through the prescribed Form XV where the law and current procedure require an update; the Copyright Office offers a separate form for this purpose.
Use written assignments and licences when granting rights to publishers, distributors, marketing agencies, developers or production partners. Check territory, permitted uses, duration, royalty treatment and whether a licence allows adaptations or sublicensing. Registration does not replace contractual administration and does not make unlicensed third-party content lawful.
If alleged copying occurs, compare the protected expression, ownership evidence, applicable exceptions and the alleged conduct. The Act provides distinct civil and criminal frameworks in appropriate circumstances, but the merits must be assessed before issuing allegations or seeking relief. An ownership entry is prima facie evidence of recorded particulars under Section 48; it is not an unchallengeable declaration.
For digital businesses, maintain a register of website copy, code repositories, commercial graphics, employee and freelancer assignments, approved stock licences, social-media assets and publication dates. Record access to high-value source files and preserve immutable versions when possible. These ordinary controls can be as important as the certificate when evidence is needed later.
Filing under the wrong class: a recording, musical composition, lyrics, artwork and film may involve distinct rights. Choose the class that corresponds to the actual subject matter rather than the most convenient fee.
Assuming copyright begins with registration: copyright can arise before filing in eligible works. The application records particulars and gives evidentiary advantages; it does not create originality or rewrite the underlying law.
Claiming an agency-created logo without reviewing the contract: examine commissioned-work arrangements and assignments before listing the business as owner. Obtain accurate author details and the relevant NOCs.
Missing commercial-artwork requirements: logos and labels used with goods or services may need the Trade Marks Registry certificate under Section 45. Copyright and trademark applications have separate tests and outcomes.
Uploading copied or licensed assets as entirely original: use only the rights actually held. Purchased stock media, open-source components, templates and generative-system outputs can require separate analysis.
Confusing submission with registration: a fee receipt or diary number does not guarantee issuance. Track discrepancies and objections and preserve the final outcome.
Ignoring exceptions, permitted uses and statutory limits: copyright protection is not absolute. Evaluate the alleged infringement and potential exceptions on the facts.
Using obsolete fee charts: older Copyright Office handbooks may contain superseded amounts. Rely on the live Second Schedule and current portal at payment.
Fictional educational scenario; not a real client case. Two entrepreneurs in Darbhanga develop an original illustrated package for a makhana snack brand. They initially operate a local business and later incorporate a private limited company to organise investment, manufacturing, ownership and governance. A freelance artist created the illustrated label, while the founders developed their brand name, written product story and website text.
The company first checks which elements are original and who owns them. The brand name raises trademark questions; the illustration may qualify as an artistic work; the website’s original narrative may be a literary work. The founders review the design contract and obtain an appropriate assignment or other title evidence before the company claims ownership of the artwork. Because the illustration is used on goods, the Section 45 commercial-artwork certificate requirement must also be considered.
The founders prepare separate work-specific filing decisions instead of putting the brand, graphics, website and packaging into a single application. They document authorship and publication, upload the relevant work and save the diary number. They also preserve the original design files, dated drafts and agency correspondence so that ownership can be substantiated later.
After incorporation, the company explores international sales. Export readiness remains a separate workstream involving applicable food-business permissions, IEC and DGFT rules, possible APEDA requirements, export banking, product classification, buyer contracts, packaging and destination-country law. Copyright registration for a label does not replace those requirements, establish a trademark abroad or guarantee an overseas order.
समीक्षा के समय आधिकारिक Second Schedule में साधारण literary, dramatic, musical या artistic work के लिए ₹500 प्रति work, commercial artistic work के लिए ₹2,000, cinematograph film के लिए ₹5,000 और sound recording के लिए ₹2,000 दर्ज हैं।
Copyright registration in India is not a universal registration that automatically records the work with every copyright authority in the world. International protection involves the relevant national law and applicable treaty framework. If an Indian publisher distributes an ebook abroad, or a Bihar food producer licences its packaging artwork to an overseas distributor, the agreement should identify the permitted territory, language, channels, duration and whether adaptation or sublicensing is permitted. Do not represent an Indian registration certificate as an international trademark, a customs approval or a guarantee of enforcement in every country.
Before entering a foreign licensing arrangement, establish the chain of title under the actual author agreements. A company may hold rights to an original illustration but not the underlying photographs, music, fonts or other third-party components contained in a composite work. Contracts should identify what the licensee receives and what remains reserved. Consider whether the foreign partner may translate, crop, reformat, modify or use a work in advertising, and who is responsible for acquiring additional permissions.
Preserve dated versions of files, publication records, assignment documents and the exact licensed deliverables. A rights schedule attached to a contract can help the parties distinguish the registered work from new derivative material or local advertising versions. Seek destination-specific legal advice where a dispute, unfamiliar law, significant commercial value or a cross-border enforcement decision makes it necessary.
For online creators, hosting a website globally does not mean that every country applies identical rules on ownership, exceptions, remedies or duration. A platform takedown request, a contractual dispute with a distributor and an infringement claim before a court are distinct processes. The appropriate route depends on the platform terms, location, evidence, rights actually held and alleged conduct.
Keep the earliest available drafts, source files and successive versions of the work with reliable dates. For books, store manuscripts, editorial correspondence and publishing agreements. For graphic art, preserve layered design files, preliminary sketches, commission instructions and licence records for any stock material. For software, retain repository history, development contracts and the particular source-code version corresponding to the application.
When a business changes its name or ownership structure, make sure its rights records do not remain scattered among former employees, freelancers or agency accounts. Assigning copyright and transferring a physical or digital copy of the work are not the same transaction. Record who may reproduce, adapt, distribute, communicate or license the work, subject to the Act and any reserved rights.
An organised evidence folder should distinguish a registration application, payment acknowledgement, diary number, office correspondence and final Register entry. If an office notice requires a correction, keep both the original submission and the revised documents. Document what was actually sent and when, instead of replacing old files without an audit trail. This improves the accuracy of later ownership, licensing and infringement analysis.
Our office can help organise the application file, identify the relevant work category, review the ownership chronology, prepare a document checklist and assist with Form XIV particulars and the supporting evidence. For artwork used on goods or services, we can flag the separate trademark-search-certificate issue and the need to coordinate the appropriate process.
Where the application involves commissioned work, multiple authors, company ownership, software or an objection, a fact-specific review is important. Registration support is distinct from an infringement suit, trademark filing, assignment negotiation or cross-border IP advice. Any proposed engagement should specify which tasks are included and which require a separate instruction.
