Design Registration in India: Process, Fees, Documents & Legal Protection

Direct answer: Design registration protects a new or original visual design applied to an article by an industrial process. Eligible features may concern shape, configuration, pattern, ornament or composition of lines or colours judged by the eye. In India, an applicant normally files Form 1 with suitable article representations, the appropriate Locarno class, a novelty statement where relevant and the prescribed fee. The Designs Act, 2000 and Designs Rules, 2001 govern registration and enforcement. A registered design initially enjoys ten years of protection from its registration date, extendable by five years on a timely application.

For Bihar entrepreneurs, design registration is particularly relevant to distinctive product containers, packaging shape, furniture, appliances, utensils and manufactured articles. A business name or logo may require a different intellectual-property assessment.

What does industrial design registration protect?

An industrial design is concerned with the appearance of an article. Section 2(d) of the Designs Act describes features of shape, configuration, pattern, ornament or composition of lines or colours applied to an article, in two-dimensional or three-dimensional form or both, by an industrial process or means. The finished article must appeal to and be judged solely by the eye. The exact article identified in the application and the representations submitted with it therefore determine much of the practical scope of the claimed design.

For example, an original external profile of a reusable food container may be a design subject. The material recipe that makes the container heat-resistant is a technical proposition, not itself the visual design. A printed surface motif may merit separate consideration from the three-dimensional bottle or box on which it appears. The application must communicate the actual visual features being claimed rather than a marketing description of the product.

The Act excludes any mode or principle of construction and anything that is in substance a mere mechanical device. It also excludes the trade mark and property mark categories specified in its definition, and artistic works as defined in Section 2(c) of the Copyright Act, 1957. These boundaries do not mean that copyright, trade mark and design rights can never be relevant to the same commercial product; they mean that each right has a different subject matter and requires a separate legal assessment.

Which designs are eligible—and what can prevent registration?

The central eligibility questions are novelty or originality, prior disclosure, distinction from known designs and compliance with the statutory definition of a design. Section 4 prohibits registration where the design is not new or original, has already been publicly disclosed anywhere in India or abroad before the applicable filing or priority date, is not significantly distinguishable from known designs or their combinations, or contains scandalous or obscene matter.

A novelty search should look beyond Indian registration numbers. Earlier domestic or overseas product catalogues, trade fairs, ecommerce listings, social-media launches, brochures and publicly accessible design databases may contain relevant disclosures. Registration is not a guarantee merely because no identical Indian registration appears in one search. Search results need visual comparison against the specific article and the features actually claimed.

Before showing a proposed design to a distributor, contract manufacturer, photographer or marketplace, consider confidentiality measures and the filing sequence. A public product launch before filing can create a serious novelty problem. The Act has particular rules for exhibitions and reciprocity claims, but applicants should not assume that an ordinary online publication attracts a general grace period. Keep dated development records and seek case-specific advice on any earlier disclosure.

How is design registration different from patents, trademarks and copyright?

A patent focuses on a qualifying technical invention, subject to the Patents Act and its own requirements of novelty, inventive step and industrial applicability. A registered design focuses on the eligible visual appearance of an article. A trade mark identifies commercial origin through a distinctive sign, name, logo or other registrable mark. Copyright concerns qualifying original works and follows a different ownership, subsistence and term framework.

An original makhana storage jar illustrates the distinction. Its decorative shape and surface ornament may be evaluated under the Designs Act. A genuinely inventive moisture-control mechanism may call for a patentability assessment. The brand name printed on its label may call for a trade mark search and application. Original packaging artwork may raise copyright and design-overlap questions. No single filing necessarily covers every layer.

Applicants should not describe design registration as a substitute for product safety certification, food licensing, FSSAI approval, quality testing, a trade mark, a patent or export permissions. A design certificate concerns a defined visual design; it does not authenticate the product’s technical claims or grant unrestricted rights to manufacture or market it.

Who may apply for registration of an industrial design?

Section 5 permits a person claiming to be the proprietor of a qualifying new or original design to apply. Depending on the ownership facts, an applicant may be an individual, a startup, a small entity, a company or another eligible legal person. Ownership should not be assumed solely because the applicant paid a designer or owns the product brand. Review the commissioning agreement, employment terms, assignment documents, contribution history and authority of the signatory.

Where a promoter designs a product before incorporating a private limited company, the eventual company should not be named as the owner without addressing the relevant chain of title. If external designers, industrial-design studios, engineering consultants or agencies contributed, written rights and confidentiality terms should be reviewed. A registered design may be commercially valuable, but uncertainty over the actual proprietor can undermine licensing, funding due diligence and enforcement.

The prescribed fee varies by applicant category. The 2021 Designs (Amendment) Rules expressly address startups and small entities and introduce Form 24 for supporting a claimed concessional category. Where an applicant relies on that status, current eligibility evidence and the required form should be checked before paying the fee. A joint or mixed-category application can attract a different fee category under the First Schedule.

How do Locarno classes and article names affect the application?

Under the 2021 amendment to Rule 10, articles are classified using the current edition of the International Classification for Industrial Designs, commonly called the Locarno Classification. The class and subclass help describe the type of article in which the design is claimed. They should be selected by reference to the actual article, not by choosing a class merely because a competitor has used it.

Section 5(3) provides that a design may be registered in not more than one class in a single registration. If the same design is intended to be registered in more than one applicable class, the rules contemplate separate applications. This becomes relevant where similar ornamental features appear on multiple commercially distinct products. The article description must remain consistent across the form, representation sheets, novelty statement and any response to an examination objection.

The class does not cure an otherwise defective application. A surface pattern that is not clearly shown on the submitted views remains hard to define even if the correct class is chosen. Similarly, naming a category too broadly can create uncertainty about the article actually represented. Review the current IP India classification resources and the corresponding WIPO classification at the time of filing.

Which documents and information are needed?

A practical filing file should combine identity and proprietorship evidence with a high-quality visual depiction of the design. The specific documents depend on the applicant, whether an agent is appointed, whether a foreign priority claim is made and the format accepted by the current electronic filing workflow. Prepare these items before filing so that inconsistencies do not generate avoidable formal objections.

  • Applicant’s full legal name, nationality, address, applicant category and Indian address for service as required.
  • Correct article name and current Locarno class/subclass.
  • Form 1 with required application particulars and applicant/agent signature.
  • Clear drawings, photographs or computer-generated article representations from relevant views.
  • Consistent novelty statement identifying the claimed visual features where appropriate or required.
  • Appropriate disclaimers for functional elements, words, trademarks, colours, dotted lines or excluded matter, as relevant.
  • Documents showing proprietorship or assignment where ownership is not self-evident.
  • Form 24 and supporting evidence if claiming startup/small-entity concessional status.
  • Agent authorisation or power, where an authorised representative is used.
  • Priority documents and translations, where a valid convention priority claim is made.
  • Fee evidence and correspondence email/address used for subsequent office communication.
  • Dated design-development material and prior-art search notes for internal review.

How should representation drawings and novelty statements be prepared?

The representation sheets are at the heart of a design application because a registered design is understood through the appearance shown in the filed materials. IP India guidance describes drawings, photographs, tracings and computer graphics as possible representation formats. Views may include perspective, front, rear, top, bottom and relevant sides, depending on the article. Each view should depict the same proposed design consistently, without contradictory contours or an unexplained change in ornament.

Use a clean, neutral background and adequate image quality so the design can be understood without advertising text, decorative shadows or unrelated objects. If part of an illustration is shown only for environmental context and not claimed, seek advice on permitted disclaimers and the visual convention used. Do not assume that a disclaimer can repair every ambiguity or expand protection beyond what the representations communicate.

A novelty statement helps explain where the applicant considers novelty to reside—for example, the shape and configuration of the container as illustrated, or the ornamental pattern applied to an identified surface. IP India’s manual contains illustrative novelty statements and disclaimers. Their wording should be adapted to the real article. Broadly copying an unrelated precedent may misidentify the claimed subject or introduce an unnecessary restriction.

What is the eight-step Indian design registration process?

The sequence begins with an ownership and novelty review and ends with monitoring the registered design and its term. The following stages are practical, but the actual application may involve office objections, hearings, amendments or refusal depending on examination.

  1. Identify the article and proposed proprietor. Record who created the design and how the applicant acquired its rights.
  2. Check novelty and earlier disclosure. Search Indian and relevant international designs, catalogues and product listings; record possible conflicts.
  3. Select the Locarno class and visual scope. Identify the precise article and whether the claim concerns shape, configuration, pattern or ornament.
  4. Prepare filing materials. Complete Form 1, consistent views, novelty statement, any disclaimers, ownership evidence, category proof and agent authorisation.
  5. Submit the application and fee. Use the current IP India process and retain acknowledgment, application number, fee receipt and exact representations filed.
  6. Address examination objections. Review each official objection and answer it with supporting facts, corrected permissible documents or submissions within the applicable time.
  7. Record registration and commercial controls. On grant, preserve the certificate/record, assess appropriate marking, and align licensing and manufacturing contracts.
  8. Monitor the term and market. Calendar the possible five-year extension, maintain records of authorised use, and assess suspected copying against the registered views and statutory remedies.

What are the government fees and cost factors?

The Designs (Amendment) Rules, 2021 First Schedule lists the Form 1 application fee as ₹1,000 for the prescribed natural-person/startup/small-entity category and ₹4,000 for the other applicant category. The same schedule lists the Form 3 extension fee as ₹2,000 and ₹8,000 respectively. Applicant classification, joint applicants and the current payment schedule must be verified when the application is prepared.

The government filing fee is only one component of the overall cost. Preparation of professional-quality representations, searches, article classification, assignment documents, responses to objections and professional charges can affect the final quote. Where several variants or classes require independent applications, the expense may rise. The page does not advertise a fixed professional charge or a guaranteed government processing time.

Before paying, check the live IP India fee schedule because rule amendments, applicant-category proof, filing mode and associated requests may alter the payment position. The official acknowledgment should be preserved in the same evidence pack as the exact Form 1 and visual representations.

Form 3 — five-year extension₹2,000₹8,000

What happens after the Design Office raises an objection?

An examiner may object to novelty or originality, the claimed design falling outside the statutory definition, an incorrect or uncertain classification, deficient representations, inconsistent forms, ownership issues or other non-compliance. An objection is not the same as a final refusal. The applicant should read the actual communication, identify the specific legal or formal issue, and calculate the applicable response period from the current Rules and notice.

An effective response may distinguish cited earlier designs, explain the overall visual impression, establish the filing chronology, supply permitted clarification or correct formal defects. A response should not invent novelty after the fact or materially change the filed design beyond what the law allows. Where a hearing is offered or required, the submissions must remain aligned with the original application and supporting records.

If the Controller refuses an application, the Designs Act provides an appeal route to the High Court in the circumstances prescribed by the Act. The proper forum, limitation period and record depend on the order and operative legal provisions. A refusal should be reviewed with the actual examination papers and order rather than challenged through a generic template.

How long does design protection last and how is it extended?

Section 11 provides the initial term of copyright in a registered design as ten years from the date of registration, with the statutory rules addressing the registration date and any qualifying priority. A further five-year period is available on an application for extension made in the prescribed manner and accompanied by the appropriate fee. Applicants should calendar this well before expiry and keep the official record of the extension.

Form 3 is the prescribed extension form. The Act and Rules also contain provisions dealing with restoration of a lapsed design in qualifying cases through Form 4 and the applicable procedure. Restoration is not an alternative to disciplined deadline management and cannot be assumed available without satisfying the relevant legal conditions.

After the available statutory term ends, the registered-design monopoly cannot simply be continued by repeatedly paying an informal renewal charge. A new design application requires an independently qualifying design and should not be used to claim that an unchanged earlier public design is automatically new. Trade mark, patent and copyright rights, if separately applicable, have their own tests and terms.

Can design registration be cancelled or challenged?

Section 19 provides a statutory cancellation mechanism. Grounds include earlier registration in India, prior publication in India or another country before the registration date, lack of novelty or originality, non-registrability under the Act and the subject not qualifying as a design within Section 2(d). Registration is therefore a legally significant recorded right, but not immunity from a challenge to validity.

For a proprietor, this reinforces the importance of a realistic novelty search and dated disclosure evidence. For a business accused of infringement, the correct inquiry is not merely whether the competitor holds a certificate: the exact registered representations, relevant class, prior art, publication dates and available statutory defences all matter.

The cancellation route should be distinguished from an examination objection before registration and from an infringement action after registration. Each has different documents, grounds, forum questions and timing. The operative procedure should be checked against current law and the actual case papers.

What protection is available against copying or design piracy?

Section 22 addresses piracy of registered designs during the subsistence of design copyright. It covers specified unauthorised application of the registered design or fraudulent/obvious imitation to relevant articles for sale, importing relevant imitations for sale, and specified publication or exposure for sale with the required knowledge. Whether particular conduct is actionable requires comparison of the registered design and the accused article, together with the statutory conditions.

The Act provides alternative civil relief mechanisms, including a statutory amount subject to the limits stated in Section 22(2)(a) or a suit seeking damages and an injunction under Section 22(2)(b). A proprietor cannot mechanically add all alternatives together. The section also addresses forum requirements and the consequences when cancellation grounds are raised as a defence. An urgent dispute needs document-specific advice on the available relief and jurisdiction.

Preserve the certificate, registered views, purchase samples, dated screenshots, invoices, advertising materials, distributor information and evidence of commercial use. Compare the appearance fairly; similarities attributable solely to functional necessity or excluded subject matter cannot be assessed in isolation from the statutory definition and registration. Before issuing a legal notice, verify the proprietor’s title, subsisting term and precise scope.

How should ownership, licensing and manufacturing contracts be handled?

A design can become a business asset only if commercial documents match the actual legal title. Where a founder commissions industrial designers, the agreement should address deliverables, background designs, ownership, assignment, confidentiality, improvements, prototype custody, permissible portfolio use and responsibility for filing information. The intellectual-property position should be discussed before a prototype is circulated to multiple vendors.

If a private company owns the design, directors should distinguish company property from the personal rights of promoters, employees or consultants. A brand owner’s control of a trade mark does not automatically prove ownership of every product design created by an outside agency. For joint development, document each contributor’s rights before the final representations and filing are approved.

Licensing arrangements should define the protected design and registered class, territory, permitted articles, quality controls, royalties where agreed, duration, sublicensing, recordal requirements, improvements and action against suspected piracy. Recordals and register updates should follow applicable Designs Act and Rules procedures; a signed private contract and an official register entry serve different functions.

What are the international filing and priority considerations?

An Indian design registration is territorial: it does not automatically create equivalent registered rights in every export destination. A Bihar manufacturer planning international sales should identify commercially relevant markets, review local filing systems and consider whether a qualifying reciprocity or convention priority claim is available under Section 44 of the Designs Act.

The Act addresses a six-month priority period for qualifying applications from convention countries or other eligible jurisdictions. The exact entitlement, required documents and timing should be checked before relying on an earlier foreign application. Priority does not excuse a defective Indian application or override the eligibility conditions governing the claimed design.

Foreign product listings and design databases are also relevant to the Indian novelty review, even if the business intends to manufacture only in Bihar. An export plan should separately evaluate trade marks, destination-country industrial-design rights, contractual ownership, packaging and labelling, customs and market-entry requirements. No Indian design certificate guarantees foreign protection or export approvals.

Fictional educational example: a Bihar makhana producer designs new packaging

Fictional example, not a client case: Three entrepreneurs in Darbhanga decide to incorporate “Mithila Harvest Foods Private Limited” for processing and packing makhana. They agree on shareholding, establish directors’ authority and arrange a registered office. A design studio then develops a distinctive reusable makhana storage container with an unusual external profile and surface pattern. The business proposes to market the packaged product domestically and explore international buyers.

The entrepreneurs first confirm whether the company or the design studio owns the proposed design under the commissioning documents. They retain confidential prototypes and check earlier Indian and international containers, packaging catalogues and ecommerce listings for potentially similar designs. They then identify the correct article and current Locarno class, prepare consistent article views and determine whether novelty is claimed in shape, surface pattern or both. The applicant category and Form 24 eligibility are reviewed before any concessional fee is claimed.

In parallel, the company considers a trade mark for its makhana brand and assesses whether its logo artwork raises separate copyright issues. If the container incorporates a functional moisture-control mechanism, that technical feature receives an independent patentability review rather than being treated as covered by the visual-design filing. The company submits its design application before the intended public product launch, subject to its actual commercial timetable and legal advice.

For international trade, it separately reviews any applicable DGFT/IEC requirements, FSSAI licensing, APEDA-related requirements, buyer contracts, food labelling, banking, customs and destination-country rules. The founders do not assume that company incorporation or design registration itself authorises export, secures orders or guarantees a commercial return. Their design filing is one component of a broader ownership and market-readiness plan.

Which practical mistakes should applicants avoid?

Launching the product publicly before assessing novelty is a common and potentially serious mistake. Another is filing hurried drawings that show inconsistent surfaces, omit important sides or include branding and functional components without considering their treatment. A later explanation cannot necessarily replace the design originally represented in the application.

Applicants also make mistakes by classifying the business activity instead of the article, assuming a company owns work commissioned before incorporation, using an applicant fee category without qualifying evidence, and treating Form 1 as a substitute for a novelty review. Filing the same general-looking article in multiple classes without separate applications can also create difficulties.

After registration, risks include overlooking the extension deadline, failing to preserve proof of licence or assignment, neglecting appropriate marking where relevant, and asserting infringement based on a broad business idea instead of the particular registered visual design. International businesses should not assume that protection follows exported articles into another country automatically.

How can Bihar Tax Consultant assist with a design-registration enquiry?

The office can coordinate an initial article-and-ownership review, help organise applicant information and product representations, identify issues requiring a novelty and classification assessment, and discuss documentation and filing support within the agreed scope. Where specialised technical drawings, foreign filing or contested infringement proceedings are involved, the applicable professional role and service arrangement should be confirmed for the individual matter.

Bihar-based startups, manufacturers, food businesses, retailers and design-led enterprises may need coordinated company-law, trade mark, copyright, GST and commercial-contract advice alongside an industrial-design filing. Such services should be evaluated separately because different registrations and legal rights answer different business questions.

The page provides general guidance only and does not promise registration, a particular examination outcome, enforcement success or a fixed processing period. For the current fee and form, consult the official IP India resources and confirm the intended ownership, article and disclosure history before filing.

How should product variants and post-registration records be managed?

Product businesses often sell a family of articles that share a visual theme but differ in size, surface pattern, configuration or ornamental detail. A registration strategy should identify which features are actually represented in each application and whether a materially different variant needs a separate filing. Do not assume that a certificate for one illustrated article creates an unlimited monopoly over every later model in the catalogue. The correct assessment compares the actual registered design, statutory provisions, related registrations and the visual appearance of each proposed variant.

Before commissioning a new mould or packaging format, retain the approved drawing revision, prototype photographs, date of designer approval and manufacturing specifications. These records help the business distinguish the original filing from later design changes. Where a new variant is prepared after an earlier design becomes public, assess its independent novelty before filing. Merely changing the article colour, size or a minor decorative detail does not automatically establish that a substantially similar later design is new or original.

After registration, maintain a central intellectual-property register recording the proprietor, application and registration numbers, Locarno class, represented article, grant and expiry dates, extension deadline, official correspondence and authorised users. Keep licence agreements and assignment documents linked to the correct registration rather than referring generally to all designs held by the business. Where register recordal is legally required or commercially prudent, check the prescribed form and current rules.

A manufacturer should also instruct marketing teams not to use statements such as “worldwide design protected” when the company holds only an Indian registration. Sales presentations, distributor contracts and product listings should distinguish a pending design application from an actual registration. Controlled use of the registration number, appropriately reviewed product marking and a calendar for renewal-related action help turn a legal filing into reliable commercial documentation.

If an investor, bank or proposed buyer requests due diligence, the evidence pack should contain the registered representations, certificate or authenticated register record, fee acknowledgments, chain-of-title documents, and a short summary of known oppositions, cancellation claims or licensing arrangements. An accurate and modest record is preferable to broad assertions of exclusivity that the underlying registration cannot support.

Perspective, front, back, top, bottom

Frequently Asked Questions / अक्सर पूछे जाने वाले प्रश्न

What is design registration in India?

It is registration under the Designs Act, 2000 of a qualifying new or original visual design applied to an article. It protects eligible appearance rather than a product’s technical function.

Is a design registration the same as a patent?

No. A design concerns eligible visual appearance; a patent concerns a qualifying technical invention. A product may require separate assessments for both.

Which form is used for a new design application?

Form 1 is the prescribed application form under Sections 5 and 44, supported by representations and the relevant fee and documents.

What are the basic government fees for Form 1?

The 2021 fee schedule lists ₹1,000 for the prescribed individual/startup/small-entity category and ₹4,000 for the other category. Confirm the current schedule before filing.

How long does a registered design last?

The initial period is ten years from the applicable registration date; a further five years is available through the prescribed extension procedure and fee.

Can I register a design after advertising the product?

Prior public disclosure anywhere may create a Section 4 obstacle. The exact circumstances and any narrowly applicable statutory provision need review.

What is Locarno classification?

It is the international classification system for industrial designs used to classify the article in a design application under the amended Indian rules.

Are product ideas protected by design registration?

An abstract business or product idea is not the registered subject. The relevant claim concerns the qualifying visual design of an identifiable article.

Can a startup receive a lower fee?

A qualifying startup or small entity may be eligible for the prescribed concessional category, subject to Form 24 and supporting status evidence.

Can a company own a design made by an outside designer?

It may, if the applicable ownership and assignment documents establish the company’s rights. Payment alone should not be treated as conclusive ownership.

Can an Indian design registration protect exports abroad?

Indian registration is territorial. Protection in other markets requires a separate review of local rights, filing routes and available priority claims.

What happens if someone copies a registered design?

Section 22 provides specified remedies for piracy of a registered design. The registered views, subsisting term, relevant article and evidence must be examined first.
