An income tax appeal is a statutory remedy to challenge an appealable order. An effective appeal requires more than uploading a form: the taxpayer should examine jurisdiction, service of the order, limitation, the facts and computations, legal grounds and the evidence already on record.

As of October 2026, two statutory regimes may be relevant. Selecting the wrong one can cause filing problems. The Income Tax Department states that appeals relating to Assessment Year 2026–27 or any earlier assessment year remain governed by the Income-tax Act, 1961, even if filed after 1 April 2026. Appeals governed by the Income-tax Act, 2025 have their own filing framework.
| Relevant matter | Statutory route | First-appeal form |
|---|---|---|
| AY 2026–27 or earlier | Income-tax Act, 1961, subject to transitional provisions | Form 35 |
| Tax year covered by the new regime beginning 1 April 2026 | Income-tax Act, 2025, where applicable | Form 99 |
| Unclear order, mixed periods or special proceeding | Determine from the order and saving / transitional rules | Confirm before filing |

Collect the assessment/penalty order, demand notice, DIN/order number, year and proof of electronic service. Determine whether the order is appealable and by whom.
Determine the legally relevant service date and deadline, considering the specific order and applicable law. If delayed, assess whether an application seeking condonation is available.
Match the additions or disallowances against returns, AIS, Form 26AS, bank statements, ledgers, agreements and explanations submitted earlier.
Explain disputed findings accurately, identify the relief sought and separate factual, computational, jurisdictional and procedural issues as appropriate.
Check applicable appeal fee and rules concerning payment of admitted tax; evaluate whether a separate stay request is needed.
Complete Form 35 or Form 99 as applicable, attach documents, verify electronically and retain the acknowledgement.
Respond to official communications, submit authorised evidence and request a hearing where available and strategically appropriate.
Examine the decision and assess effect-giving, rectification, further appeal or other legally available remedies, including their deadlines.
Not every case requires every item. Additional evidence at appellate stage may be subject to specific admission rules. Do not upload third-party sensitive records before confirming an appropriate secure intake channel.
For an ordinary first appeal under the 1961 Act, Section 249(2) generally provides 30 days, counted from the statutory trigger that applies to the case—commonly service of the relevant notice of demand for an assessment or penalty appeal, or service of the order in other cases. The Income Tax Department also states a general 30-day first-appeal period under the 2025 Act. The actual final date must be calculated case by case.
| Assessed total income | Form 35 statutory appeal fee |
|---|---|
| Up to ₹1,00,000 | ₹250 |
| Above ₹1,00,000 and up to ₹2,00,000 | ₹500 |
| Above ₹2,00,000 | ₹1,000 |
Different categories of orders may have a separately specified fee. These government filing fees are not the professional service fee and are not percentages of the disputed demand. For a new-regime appeal, check the applicable Form 99 instructions and law rather than applying this table automatically.
In appropriate cases, an appeal authority may consider condonation of delay on a substantiated showing of sufficient cause. It is discretionary, not automatic. Assemble a chronology and documents supporting the reason for delay.

When an appeal challenges a large demand, cash-flow and recovery exposure may require attention independent of the merits of the appeal. A stay request should address the disputed additions, available relief, financial circumstances, earlier payments and applicable administrative or judicial guidance.
Challenges the merits, legality or computation of a decision before the appropriate authority.
Seeks protection from recovery subject to the authority’s statutory powers and any imposed conditions. A stay is not guaranteed.

Not every notice is appealable immediately. Some issues instead require a notice reply, correction request, rectification, revision or another remedy. The first step is to identify the exact order and relief available.
